Terms of Service

1. Scope and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Sunshine application and related services (the "Service"), operated by Starsong GmbH, Zur Marktflagge 3, 10247 Berlin, Germany ("we", "us", "our"). Full provider details are in our Legal Notice.

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms are supplemented by our Privacy Policy.

2. The Service

Sunshine is an open source project for managing unu/librescoot electric scooters. It lets you monitor scooter telemetry, view trips and location history, send commands to your scooter, and share access with other users. The Service is provided free of charge and is operated on a best-effort, community basis.

Sunshine is not officially affiliated with unu GmbH. Use of the Service depends on third-party hardware, firmware, and connectivity that we do not control.

3. Eligibility and Accounts

  • You must be at least 16 years old to use the Service.
  • You must provide accurate account information and keep it up to date.
  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • Notify us promptly at contact@rescoot.org if you suspect unauthorized use of your account.

4. Your Scooter and Remote Control

The Service can send commands that affect a physical vehicle, including unlocking the scooter and opening the seatbox. You acknowledge and agree that:

  • You may only connect and control scooters that you own or are otherwise authorized to operate.
  • You are solely responsible for the safe, lawful, and roadworthy operation of your scooter, including compliance with all applicable traffic, registration, and insurance requirements.
  • You must not rely on the Service for safety-critical functions. Commands may be delayed, lost, or fail to execute due to connectivity, hardware, or firmware conditions outside our control.
  • When you share scooter access with another user, you are responsible for who you grant access to and what they are permitted to do.

5. Acceptable Use

You agree not to:

  • Use the Service in any way that is unlawful, or that infringes the rights of others.
  • Access scooters, data, or accounts that do not belong to you and that you are not authorized to access.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
  • Reverse engineer, scrape, or abuse the Service or its API beyond what is permitted by the applicable open source license and these Terms.
  • Use the Service to transmit malware or to engage in fraudulent or harmful activity.

6. Third-Party Services

The Service relies on third-party providers and integrations (for example hosting, MQTT brokers, error monitoring, weather data, and optional Discord account linking). Your use of those integrations may be subject to the respective third party's terms and privacy policies. We are not responsible for third-party services we do not control.

7. Intellectual Property and Open Source

Sunshine is an open source project. The source code is made available under its applicable open source license, and your use of the code is governed by that license. These Terms govern your use of the hosted Service we operate, and do not limit any rights you have under the open source license to the code itself. Trademarks, logos, and brand names referenced in the Service remain the property of their respective owners.

8. Availability and "As Is"

The Service is provided free of charge, "as is" and "as available", without any service level guarantee. We may modify, suspend, or discontinue all or part of the Service at any time without notice. We do not warrant that the Service will be uninterrupted, error-free, or that data will not be lost. We recommend you keep your own records of any data that is important to you.

9. Liability

We are liable without limitation for damages arising from injury to life, body, or health, for damages caused by intent or gross negligence, and to the extent of any mandatory statutory liability (for example under the German Product Liability Act).

For slight negligence, we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely). In that case our liability is limited to the foreseeable damage typical for this kind of contract. Any further liability for slight negligence is excluded.

Because the Service is provided free of charge, the foregoing limitations apply to the maximum extent permitted by law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law, including your statutory rights as a consumer.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including those on liability, intellectual property, and governing law) remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, please stop using the Service.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. Where permitted by law, the place of jurisdiction is Berlin, Germany.
